[89] Secondly, it was a matter for Ms Walker, at the time the disciplinary process was commenced against her about parking in a restricted zone, to make the case that it was not her that had parked in a restricted zone. Ms Walker did not make that submission and, as a consequence, a non-disciplinary warning was issued to her. Having regard to that fact, it was misleading for Ms Walker to have submitted to Mr Calvert, as part of the disciplinary process in respect of the two substantiated allegations, that she had an unblemished employment record. In any event, the Industrial Commissioner's task was to determine whether or not Ms Walker's dismissal was harsh, unjust or unreasonable. It was not for the Industrial Commissioner to have to re-determine whether or not the non-disciplinary warning should have been issued to Ms Walker, although that issue was relevant to determine if, for the reasons she advanced, her dismissal was harsh, unjust or unreasonable.
