reasons for decision
- This is an interlocutory motion by the respondent Commissioner seeking confidentiality for certain evidentiary material and exemption from the obligation to file and serve certain documents as required by s 58 of the Administrative Decisions Review Act 1997 (ADR Act).
- The applicant Mr Ben Reakes applied to this tribunal on 10 November 2020 for review of a decision by the respondent Commissioner made on 14 October 2020 to revoke his category ABC firearms licence.
- The applicant had held a category AB firearms licence for the purpose of recreational hunting and vermin control between 28 August 2008 and 16 October 2013. His last licence authorized him to possess and use category ABC firearms for the purposes of recreational hunting and vermin control, and primary production.
- On 7 August 2015 he presented at hospital in a severely intoxicated state, with lacerations to his head and arms, and suspected head and neck injuries. It was alleged that on 28 July 2019, he had sent numerous text messages to Raechel Weaver, his former de facto partner, with whom he was involved in legal action in the Canberra Federal Court over the division of assets. The messages related to the financial settlement and police observed that they became increasingly abusive. He also said "I am down anyway so might as well go out with a bang", and included comments placing Ms Weaver's new partner at the top of his "destruction list", adding "Take this as a threat or whatever you wish but trust me it's very real". He also said he was observing their vehicles through scopes.
