- There be declarations that: (i) The respondent is not entitled to the payment of any additional licence fees or upgrade maintenance service fees pursuant to the Licence Agreement in respect of the installation of the copy of the System, the licence of which is the subject of the agreement, on the applicant's off-site disaster recovery mainframe. (ii) The applicant has not by making and storing the disaster recovery copy of the System at a third party site operated by KAZ Technology Services Pty Ltd, breached the Licence Agreement. (iii) The applicant is entitled to test the disaster recovery copy pursuant to the terms of the Licence Agreement and in any event pursuant to s 47F of the Copyright Act 1968 (Cth) in accordance with its testing process.
