This is the appeal of Stuart Michael Pascoe against his conviction at a trial in the Supreme Court in May 1997 of the murder of John Edward Timms. Pascoe was one of four men charged with that murder, of whom the other three were brought to trial jointly in June 1996. Of those three, Andrew Jeffrey and Mark Donald were found guilty, and their appeals (CA 154 of 1996 and C.A. 309 of 1996) are the subject of separate decisions on those appeals in this Court. The fourth one charged was Aaron Johnson, who was a juvenile at the time of these events. After a voir dire had been held, the record of interview was excluded from evidence at his joint trial with the other two, and the Crown then entered a nolle prosequi against him on that indictment.
