CRIMINAL LAW --- PARTICULAR OFFENCES --- OFFENCES AGAINST THE PERSON --- OTHER OFFENCES AGAINST THE PERSON --- SEXUAL OFFENCES
APPEAL AGAINST SENTENCE Appellant found guilty after a trial by jury of six counts of unlawful sexual intercourse with a person under the age of 12 years, three counts of indecent assault and one count of offering a benefit to a witness - consideration of appropriate sentencing standard where offences occurred many years ago - appellant aged 57 years - consideration of possibility of his dying in prison or shortly after release - significance of otherwise previous and subsequent good character, loss of profession and employment, special disopprobrium, distress and stress and lapse of time between offending and sentence - whether lack of subsequent offending indicates rehabilitation - consideration of effect of sentence upon appellant's elderly mother - victim impact statements - consideration of whether relatives of primary victims are victims - contents of victim impact statements - power to exclude parts of such statements where irrelevant - whether sentence imposed upon a factual basis which was not proved - use of evidence of uncharged acts - appellant unrepresented at sentencing hearings - whether proceedings should be adjourned - sentence and non-parole period not manifestly excessive - need to re-sentence because conviction on one count set aside and conviction on lesser charge entered - consideration of state of health of the appellant since sentence imposed and conditions in solitary confinement - consideration of significance of financial losses sustained by the appellant - appeal dismissed.
