1 The plaintiff was a temporary teacher employed by the first defendant from 1977 to 1985, and from 1989 to September 2004, pursuant to s 9 of the Teaching Service Act 1981 ("the Act"). For the last 15 years, he was employed as a teacher at the Upper Yarra Secondary College. Following complaints made in relation to him, the Acting Deputy Secretary of the Office of School Education, in December 2003, removed the plaintiff from teaching duties pending the outcome of procedures instituted under the Act. There then followed a lengthy process of investigation and review. Ultimately, on 19 February 2008, the Merit Protection Boards confirmed the recommendation of an investigator, appointed by the Deputy Secretary, that the plaintiff not be reinstated to the teaching service. In these proceedings, the plaintiff claims relief in the nature of certiorari in respect of that determination.
