"The evidence of Pitts on this topic was as implausible as was the evidence of Ann Hunter. He told me that while living at the premises he did not pay rent and he did not know that the rent was $180 per week; he did not know that Ray White Everton Park was the agent for collecting rent; at the time he believed the premises were rented by Edward Morales and despite, as he asserted, living in the house for 3 months, neither he nor Ann Hunter paid rent nor found out who the letting agents were. Pitts did not know who was paying rent nor did he pay nor have any idea as to who was paying for telephone or electricity in the house. He did not obtain the keys to the premises from the letting agents nor did he tell the letting agents of a change in the tenancy. Although the premises were furnished he did not find out who owned the furnishings. I thought he was most uncomfortable in answering questions concerning his claim that he lived at the house at 7 Grevillea Street. I formed the very firm and clear view that when reasonably early in her cross-examination, Ann Hunter realised the nature of the material which defence counsel had and on which they wished to question her she, out of her desire to conceal or to put it mildly minimise Edward Morales' involvement in the affairs of the plaintiff and the receipt by him of financial benefits from the plaintiff and perhaps out of exasperation with the cross-examiners, decided to tell me in evidence that she and Ken Pitts, then her fiancee, had lived in the 7 Grevillea Street premises for the period which she claimed. In my view Pitts came to court to support the evidence which his wife had already given. I am satisfied beyond reasonable doubt that he knowingly gave false evidence concerning this topic. As the cross-examination proceeded he was asked more penetrating questions e.g. concerning payment of the rent, telephone and the electricity and his answers highlighted the fact that his claim that he was living in the house rent free and cost free was quite insupportable. Pitts as I have found had a financial interest in the outcome of its case and I find it more likely than not that that, coupled with the desire to support his wife, has led him to give false testimony to me."
