Introduction
- The alleged breach of s 66(2)(e) of the RV Act by the respondent is set out by the applicant in the following terms in the applicant's case summary: "Harassment and bullying 23. The Applicant has complained to the Respondent since at least November 2018 of the constant harassment, noise, abuse she has suffered from her immediate neighbours. … 31 The Applicant submits that the Respondent, as the operator of the Village, has breached section 66(2) (a), (b) and (e) as the Respondent has not taken steps to protect the Applicants quiet enjoyment of their premises and used "his or her best endeavours to ensure that each resident lives in an environment free from harassment and intimidation"."
- The applicant's complaints are about two other residents of the village who reside in units 8 and 6. I will refer to these residents as person A and person B respectively.
- The retirement villages application so far as the alleged breach of s 66(2)(e) of the RV Act by the respondent has been brought under each of s 66(3) and 122(1) of the RV Act.
- Neither of the parties in their written or oral submissions raised the issue of whether the proceedings so far as the alleged breach of s 66(2)(e) of the RV Act by the respondent were commenced within the prescribed period, and if not time for their commencement should be extended. As the applicant was not legally represented, I have proceeded on the basis that the applicant has to the extent necessary made an application to extend time for the commencement of the proceedings so far as the alleged breach of s 66(2)(e) of the RV Act by the respondent, and dispensed with the requirement under r 8 of the NCAT Rules that the application be in writing.
- Before considering this issue, it is necessary to set out the evidence of the parties. In setting out the evidence of the parties, I have focussed on the documents to which each the applicant and the respondent drew attention in their written and oral submissions.
