Introduction
- This is an application by the Applicant, Mr Mayr, for review of an order made by the Tribunal on 7 April 2017 cancelling his registration as a psychologist. Mr Mayr seeks a reinstatement order under s 163B(1)(c) of the Health Practitioner Regulation National Law (NSW) (National Law).
- On 7 April 2017 the Tribunal found that each of the particulars of complaints of unsatisfactory professional conduct against Mr Mayr were made out and that the complaints cumulatively amounted to professional misconduct: Health Care Complaints Commission v Mayr [2017] NSWCATOD 52 (HCCC v Mayr).
- The Tribunal cancelled Mr Mayr's registration and made an order that Mr Mayr could not apply for a review of the cancellation order for a period of five years.
- The Tribunal also made an order prohibiting Mr Mayr from providing a series of other health services, namely community health services, counselling, health education services, mental health services, supervision or coaching of psychologists, psychology students or any allied health services and welfare services or any allied health services necessary to implement the prohibited services, unless and until he obtains re-registration as a psychologist.
- The Health Care Complaints Commission (HCCC) appeared as a contradictor in these proceedings. The HCCC opposes a reinstatement order and seeks an order under s 163B(5) of the National Law that the order cancelling Mr Mayr's registration may not be reviewed until after a further two years.
