REASONS FOR DECISION
- The Tribunal has decided that the respondent, a legal practitioner, is guilty of professional misconduct: Law Society of NSW v Shehadie [2016] NSWCATOD 46 (20 April 2016) (the liability decision). This decision deals with the issue of the appropriate disciplinary orders.
- We dealt in our liability decision with four charges laid by the Council of the Law Society pursuant to the Legal Profession Act 2004, the applicable law at the relevant times ('the Act'). The offences came to light as a result of an investigation completed in April, 2013 stimulated by the regular trust account inspection that took place in 2012. The respondent has been in practice for almost 40 years and for most of that time has practised as a principal. Prior to the matters the subject of these proceedings he had no adverse disciplinary record.
