EVIDENCE - PUBLIC INTEREST IMMUNITY - POLICE INFORMER During the course of a preliminary examination on charges of murder, the presiding magistrate held that a claim for public interest immunity advanced by the prosecution with respect to the record of a statement given by one of the co-accused to the investigating police officers at an early stage of the investigation, should be left to be determined by the trial judge - in the meantime, he declined access to it by the three co-accused - the statement was given in confidence, with an assurance that it would not be used in evidence unless by order of the court - on an application for judicial review, referred to the Full Court, held that the magistrate had failed to exercise his jurisdiction by failing to rule on the merits of the claim for public interest immunity - discussion of relevant tests to be applied in cases where informer immunity claimed - discussion of significance of material to the defence case - desirability of affidavit to support claim for immunity - on a reconsideration of the matter, held that the claim for immunity should be upheld.
