1 This is an appeal from a decision of a Deputy President upholding the respondent's discontinuance of the appellant's weekly payments of compensation on the ground of the appellant's dismissal from his employment for serious and wilful misconduct pursuant to s 36(1)(e) of the Workers Rehabilitation and Compensation Act 1986 ("the Act").
2 Mr Barrett QC, for the appellant, submitted that the learned Deputy President's decision involved an error of law in one of two ways. Firstly, the learned Deputy President had failed to make necessary findings on the disputed factual matters, thereby indicating that he had not taken into account all the surrounding circumstances and in particular the appellant's explanations for his conduct. Failure to have regard to all the surrounding circumstances was, he submitted, an error of law.
