### sec.410 Application of s 246A and former s 246
To remove any doubt, it is declared that—
section 246A applies to a breach of a conditional release order made in relation to a prescribed indictable offence if the breach occurs after the commencement, whether the conditional release order was made before or after the commencement; and
section 246, as in force immediately before the commencement, continues to apply to a breach of a conditional release order made in relation to a prescribed indictable offence if the breach occurred before the commencement.

- (a) section 246A applies to a breach of a conditional release order made in relation to a prescribed indictable offence if the breach occurs after the commencement, whether the conditional release order was made before or after the commencement; and
- (b) section 246, as in force immediately before the commencement, continues to apply to a breach of a conditional release order made in relation to a prescribed indictable offence if the breach occurred before the commencement.
