### sec.308 Proceeding for offence A proceeding for an offence against this Act must be taken in a summary way under the Justices Act 1886 . In a proceeding for an offence against this Act, a police officer or a public service officer may appear for the prosecution even though not a complainant or arresting officer. A reference in this Act to a lawyer acting for a party includes anyone appearing for the prosecution under subsection (2) . s 308 amd 1996 No. 22 s 85 ; 1998 No. 39 s 65 ; 2004 No. 11 s 596 sch 1 (sec.308-ssec.1) A proceeding for an offence against this Act must be taken in a summary way under the Justices Act 1886 . (sec.308-ssec.2) In a proceeding for an offence against this Act, a police officer or a public service officer may appear for the prosecution even though not a complainant or arresting officer.
