### sec.239 Cancellation of warrant This section applies if— a warrant for a child’s arrest is issued under section 238 ; and the child appears before a Childrens Court magistrate other than through the execution of the warrant. The magistrate may cancel the warrant and deal with the child under this division for the alleged contravention of the community based order. s 239 ins 2002 No. 39 s 98 (sec.239-ssec.1) This section applies if— a warrant for a child’s arrest is issued under section 238 ; and the child appears before a Childrens Court magistrate other than through the execution of the warrant. (sec.239-ssec.2) The magistrate may cancel the warrant and deal with the child under this division for the alleged contravention of the community based order. - (a) a warrant for a child’s arrest is issued under section 238 ; and - (b) the child appears before a Childrens Court magistrate other than through the execution of the warrant.
