### sec.104 Charge other than committal charge—election by legally represented child for trial with or without jury This section applies to a charge against a child of an indictable offence before a Childrens Court judge that is not a committal charge mentioned in section 102 . If the child is represented by a lawyer, the child may elect— to be tried before the judge sitting without a jury; or to be tried before the judge sitting with a jury. An election must happen before the child enters a plea to the charge. s 104 ins 2002 No. 39 s 26 amd 2004 No. 11 s 596 sch 1 (sec.104-ssec.1) This section applies to a charge against a child of an indictable offence before a Childrens Court judge that is not a committal charge mentioned in section 102 .
