15 Outworkers
(1) This section applies to an individual (the outworker) who is engaged
by a person (the principal) under a contract for services to treat or
manufacture articles or materials, or to perform other services—
(a) in the outworker’s own home; or
(b) on other premises not under the control or management of the
principal.
(2) To remove doubt, the outworker is taken to be a worker employed by
the principal if—
(a) the outworker is taken to be a worker employed by the principal
under section 11 (Regular contractors and casuals); or
(b) the outworker is taken to be a worker employed by the principal
under section 12 (Labour hire arrangements).
Example of an outworker
A keyboard operator engaged under a contract for services by an information
technology firm to undertake data conversion for the firm (or for another firm) in
the operator’s home.
