### sec.79 False or misleading information and documents
A person must not—
make a statement to an authorised officer that the person knows is false or misleading in a material particular; or
omit from a statement made to an authorised officer anything without which the statement is, to the person’s knowledge, misleading in a material particular.
Maximum penalty—100 penalty units.
A complaint against a person for an offence against subsection (1) (a) or (b) is sufficient if it states that the statement made was false or misleading to the person’s knowledge.
A person must not give to an authorised officer a document containing information that the person knows is false, misleading or incomplete in a material particular.
Maximum penalty—100 penalty units.
Subsection (3) does not apply to a person if, when the person gives the document to the authorised officer, the person—
indicates to the officer that the document is false, misleading or incomplete; and
indicates the respect in which the document is false, misleading or incomplete; and
gives the correct information to the officer if the person has, or can reasonably obtain, the correct information.

- (a) make a statement to an authorised officer that the person knows is false or misleading in a material particular; or
- (b) omit from a statement made to an authorised officer anything without which the statement is, to the person’s knowledge, misleading in a material particular.
- (a) indicates to the officer that the document is false, misleading or incomplete; and
- (b) indicates the respect in which the document is false, misleading or incomplete; and
- (c) gives the correct information to the officer if the person has, or can reasonably obtain, the correct information.
