### sec.31 Licensee’s representative
This section applies to—
a licensee who holds a licence to enable the licensee to carry on business; and
an applicant for a licence to enable the applicant to carry on business.
The licensee or applicant may apply for the licence to be endorsed with the name of a fit and proper individual as the licensee’s or applicant’s representative in the conduct of its business or affairs at the place stated in the application.
A licensee may apply for the licence to be endorsed with the name of a fit and proper individual instead of another person already endorsed as the licensee’s representative under this or another section.
An application under subsection (2) or (3) must be made in the approved form in the way prescribed under a regulation.
In this section—
fit and proper individual means an individual who, if the person applied for a licence, would be a fit and proper person under section 10B .
