### sec.645 Owner of existing dam must prepare and submit emergency action plan This section applies to the owner of a dam (an existing dam ) that— immediately before the commencement was a referable dam; and is a referable dam under section 341 on and after the commencement. The owner of the dam must, unless the owner has a reasonable excuse, prepare an emergency action plan for the dam under chapter 4, part 1, division 2A, subdivision 3 and give it to the chief executive for approval before 1 October 2013. Maximum penalty—1,665 penalty units.
