### sec.637 Provision for recovery of costs for particular investigations
This section applies if the regulator has, after 13 May 2009 but before the commencement, engaged an expert to give the regulator advice about a suspected contravention of a provision of this Act by an entity before the commencement.
Section 468(3) to (6), other than section 468(4)(d), applies for the engagement of the expert as if that section had commenced on 13 May 2009.
To remove any doubt, it is declared that if the regulator claims an amount under section 468(3) because of the operation of subsection (2), the amount, and any interest payable on the amount under section 468(6)—
is a debt owing to the regulator; and
may be recovered by the regulator as a debt.
If a notice is given under section 468 because of the operation of subsection (2), chapter 7 does not apply in relation to the notice.
In this section—
commencement means the day this section commences.
