### sec.438 Particular powers of regulator or authorised officer
If the regulator decides to take the reasonable steps, or authorise an authorised officer to take the reasonable steps, the regulator or officer may—
without a warrant, enter any place, other than premises or a part of premises where a person resides, to take the steps; and
in taking the steps, exercise any powers of an authorised officer under part 2 , 3 or 4 .
Before entering a place under subsection (1) (a) , the regulator must do or make a reasonable attempt to do the following—
tell the occupier of the place the regulator is permitted under this Act to enter the place;
give the occupier an opportunity to allow the regulator immediate entry to the place without using force.
Before entering a place under subsection (1) (a) , the authorised officer must do or make a reasonable attempt to do the following—
comply with section 405 (1) ;
tell the occupier of the place the officer is permitted under this Act to enter the place;
give the occupier an opportunity to allow the officer immediate entry to the place without using force.

(sec.438-ssec.3) Before entering a place under subsection (1) (a) , the authorised officer must do or make a reasonable attempt to do the following— comply with section 405 (1) ; tell the occupier of the place the officer is permitted under this Act to enter the place; give the occupier an opportunity to allow the officer immediate entry to the place without using force.
- (a) without a warrant, enter any place, other than premises or a part of premises where a person resides, to take the steps; and
- (b) in taking the steps, exercise any powers of an authorised officer under part 2 , 3 or 4 .
- (a) tell the occupier of the place the regulator is permitted under this Act to enter the place;
- (b) give the occupier an opportunity to allow the regulator immediate entry to the place without using force.
