### sec.352F Requirement to prepare emergency action plan
The owner of a referable dam must, unless the owner has a reasonable excuse, prepare an emergency action plan for the dam under subdivision 3 and give it to the chief executive for approval—
if construction of the dam is not finished when the chief executive accepts a failure impact assessment for the dam under section 349 —
within 3 months after the construction is finished; or
if the chief executive gives the owner of the dam a notice requiring the emergency action plan before the construction is finished—within the period of at least 30 business days stated in the notice; or
if construction of the dam has finished when the chief executive accepts a failure impact assessment for the dam—within 4 months after the chief executive accepts the failure impact assessment; or
if the dam becomes a referable dam under section 342B —within 4 months after the day it becomes a referable dam.
Maximum penalty—1,665 penalty units.

- (a) if construction of the dam is not finished when the chief executive accepts a failure impact assessment for the dam under section 349 — (i) within 3 months after the construction is finished; or (ii) if the chief executive gives the owner of the dam a notice requiring the emergency action plan before the construction is finished—within the period of at least 30 business days stated in the notice; or
- (i) within 3 months after the construction is finished; or
- (ii) if the chief executive gives the owner of the dam a notice requiring the emergency action plan before the construction is finished—within the period of at least 30 business days stated in the notice; or
- (b) if construction of the dam has finished when the chief executive accepts a failure impact assessment for the dam—within 4 months after the chief executive accepts the failure impact assessment; or
- (c) if the dam becomes a referable dam under section 342B —within 4 months after the day it becomes a referable dam.
- (i) within 3 months after the construction is finished; or
- (ii) if the chief executive gives the owner of the dam a notice requiring the emergency action plan before the construction is finished—within the period of at least 30 business days stated in the notice; or
