What it does
The Water Services Act 2012 (WA) establishes the regulatory framework for water service providers in Western Australia. It requires providers to hold licences, sets the conditions under which those licences are granted and maintained, and gives the Economic Regulation Authority (the Authority) and the Minister powers to enforce compliance. The Act also regulates the physical infrastructure through which water services are delivered, including how works may be constructed on and across private and Crown land.
The Act applies to providers of drinking water, non-drinking water, sewerage, drainage, and irrigation services (section 8). It covers both commercial licensees and, by extension, statutory providers such as the Water Corporation (section 6). It replaces legislation repealed by the Water Services Legislation Amendment and Repeal Act 2012, with Schedule 1 transitional provisions preserving existing licences and approvals.
