### sec.40A Chief executive may temporarily release water from reserve
The chief executive may temporarily release water from a strategic water infrastructure reserve for a purpose other than that stated in a water planning instrument.
The chief executive must release the water under the process prescribed under section 39 (b) .
This is the process under section 40 (2) .
However, the process can make the water available only under a water licence.
Also, a water licence granted for the release must be granted for a stated term of not more than 3 years.
Despite section 106 (3) , the water licence can not be renewed, reinstated, relocated, amalgamated or subdivided.
This section applies despite any provision of a water planning instrument relating to the release of water from the reserve.

(sec.40A-ssec.1) The chief executive may temporarily release water from a strategic water infrastructure reserve for a purpose other than that stated in a water planning instrument.
(sec.40A-ssec.2) The chief executive must release the water under the process prescribed under section 39 (b) . This is the process under section 40 (2) .
(sec.40A-ssec.3) However, the process can make the water available only under a water licence.
