### sec.396 Method of undertaking baseline assessment
In undertaking a baseline assessment of a water bore, a resource tenure holder must comply with—
guidelines made by the chief executive under section 395 ; or
if there are no guidelines—best practice industry standards for carrying out work similar in nature to undertaking a baseline assessment.
Maximum penalty—50 penalty units.
However, subsection (1) does not apply to a baseline assessment that was undertaken before the commencement of this section if the holder obtained information about the water bore that substantially meets the requirements of section 394 and any guidelines made by the chief executive under section 395 .
