### sec.25ZB Deciding application
The chief executive must give the approval if the chief executive is satisfied that—
the subartesian water and the water service provider’s water supply for a retail water service is being taken from the same source; and
the taking of the subartesian water may threaten the security of the water service provider’s water supply for the retail water service; and
service provider water restrictions have been imposed, or are about to be imposed, in relation to the water supply.
If the chief executive is not satisfied about the matters mentioned in subsection (1) (a) , (b) and (c) , the chief executive must refuse to give the approval.
The approval may be given with or without conditions.

(sec.25ZB-ssec.1) The chief executive must give the approval if the chief executive is satisfied that— the subartesian water and the water service provider’s water supply for a retail water service is being taken from the same source; and the taking of the subartesian water may threaten the security of the water service provider’s water supply for the retail water service; and service provider water restrictions have been imposed, or are about to be imposed, in relation to the water supply.
(sec.25ZB-ssec.2) If the chief executive is not satisfied about the matters mentioned in subsection (1) (a) , (b) and (c) , the chief executive must refuse to give the approval.
(sec.25ZB-ssec.3) The approval may be given with or without conditions.
- (a) the subartesian water and the water service provider’s water supply for a retail water service is being taken from the same source; and
- (b) the taking of the subartesian water may threaten the security of the water service provider’s water supply for the retail water service; and
- (c) service provider water restrictions have been imposed, or are about to be imposed, in relation to the water supply.
