### sec.1290 Election notice
This section applies if, before the commencement—
a party gave, under section 426 as in force before the commencement, another party an election notice—
asking for an authorised officer to call a conference to negotiate a resolution of a dispute; or
calling upon the party to agree to an ADR to negotiate a resolution of a dispute; and
the conference, or the ADR, was not finished under section 427 as in force before the commencement.
This Act, as in force immediately before the commencement, continues to apply in relation to—
the conference or ADR; and
any proceeding in the Land Court, whether started before or after the commencement, that relates to the matters the subject of the dispute.
The new arbitration provisions do not apply in relation to the matters the subject of the dispute.
In this section—
new arbitration provisions means the provisions inserted into chapter 3 , part 5 under the Mineral, Water and Other Legislation Amendment Act 2018 .

(sec.1290-ssec.2) This Act, as in force immediately before the commencement, continues to apply in relation to— the conference or ADR; and any proceeding in the Land Court, whether started before or after the commencement, that relates to the matters the subject of the dispute.
(sec.1290-ssec.3) The new arbitration provisions do not apply in relation to the matters the subject of the dispute.
