### sec.109 When application may not be made An application can not be made for a water licence— for an activity the applicant is authorised to do under part 3 , division 1 ; or in relation to the release of unallocated water. Subsection (1) (b) does not apply to an application that is part of a process prescribed under section 40 (2) . s 109 amd 2001 No. 75 s 3 sch 2 ; 2005 No. 19 s 25 sub 2014 No. 64 ss 67 (1) , 68 ; 2019 No. 17 s 327 (sec.109-ssec.1) An application can not be made for a water licence— for an activity the applicant is authorised to do under part 3 , division 1 ; or in relation to the release of unallocated water. (sec.109-ssec.2) Subsection (1) (b) does not apply to an application that is part of a process prescribed under section 40 (2) . - (a) for an activity the applicant is authorised to do under part 3 , division 1 ; or - (b) in relation to the release of unallocated water.
