### sec.1070 Failure impact assessing small licensed dams
Subsection (2) applies to a dam if a licence was granted under section 43 of the repealed Act for the dam and the dam is not—
more than 8m in height and does not have a storage capacity of more than 500ML; or
more than 8m in height and does not have a storage capacity of more than 250ML and a catchment area that is not more than 3 times its maximum surface area at full supply level.
On the commencement of this section, the conditions about the safety of the dam, that applied to the licence, no longer apply.
(sec.1070-ssec.1) Subsection (2) applies to a dam if a licence was granted under section 43 of the repealed Act for the dam and the dam is not— more than 8m in height and does not have a storage capacity of more than 500ML; or more than 8m in height and does not have a storage capacity of more than 250ML and a catchment area that is not more than 3 times its maximum surface area at full supply level.
(sec.1070-ssec.2) On the commencement of this section, the conditions about the safety of the dam, that applied to the licence, no longer apply.
- (a) more than 8m in height and does not have a storage capacity of more than 500ML; or
- (b) more than 8m in height and does not have a storage capacity of more than 250ML and a catchment area that is not more than 3 times its maximum surface area at full supply level.
