### sec.99ZC When container refund point operator must not claim payment
The operator of a container refund point must not claim payment of an amount from the Organisation under a container collection agreement if the payment relates to a container and any of the following apply—
the operator has not paid a refund amount for the container;
the container is not registered;
the operator knows, or ought reasonably to know, the container has been disposed of to landfill, whether or not the operator has paid a refund amount for the container.
Maximum penalty—300 penalty units.
Subsection (1) (c) does not apply to a container that is the subject of an extraordinary circumstances exemption.

- (c) the operator knows, or ought reasonably to know, the container has been disposed of to landfill, whether or not the operator has paid a refund amount for the container.
