### sec.35 Chief executive may declare waste to be exempt waste in exceptional circumstances
This section applies if the chief executive is satisfied that exceptional circumstances apply for—
particular waste or a type of waste; or
the disposal of particular waste or a type of waste.
The chief executive may, by publication on the department’s website, declare the waste to be exempt waste.
The chief executive may declare waste to be exempt waste subject to any limits or conditions included in the declaration of the waste as exempt waste.
A declaration of waste as exempt waste has effect subject to any limits or conditions included in the declaration.

(sec.35-ssec.1) This section applies if the chief executive is satisfied that exceptional circumstances apply for— particular waste or a type of waste; or the disposal of particular waste or a type of waste.
(sec.35-ssec.2) The chief executive may, by publication on the department’s website, declare the waste to be exempt waste.
(sec.35-ssec.3) The chief executive may declare waste to be exempt waste subject to any limits or conditions included in the declaration of the waste as exempt waste.
(sec.35-ssec.4) A declaration of waste as exempt waste has effect subject to any limits or conditions included in the declaration.
- (a) particular waste or a type of waste; or
- (b) the disposal of particular waste or a type of waste.
