### sec.162 Preparation of end of waste code
Subsection (2) applies if the chief executive decides to prepare a draft end of waste code (the draft code ).
The chief executive may establish a technical advisory panel under section 173G to prepare the draft code.
If the chief executive establishes a technical advisory panel to prepare the draft code—
the chief executive may require the panel to include particular requirements in the draft code; and
the panel must prepare and give the chief executive the draft code by the day stated in the schedule.
However, the technical advisory panel may, after having regard to the matters mentioned in section 163 (1) but within 2 months of being established, recommend to the chief executive that the draft code should not be prepared.
The technical advisory panel’s recommendation under subsection (4) must be given to the chief executive in writing and include the panel’s reasons for the recommendation.
If the chief executive does not establish a technical advisory panel to prepare the draft code, the chief executive must prepare the draft code by the day stated in the schedule.
In this section—
schedule means the schedule published under section 159B .

(sec.162-ssec.1) Subsection (2) applies if the chief executive decides to prepare a draft end of waste code (the draft code ).
(sec.162-ssec.2) The chief executive may establish a technical advisory panel under section 173G to prepare the draft code.
(sec.162-ssec.3) If the chief executive establishes a technical advisory panel to prepare the draft code— the chief executive may require the panel to include particular requirements in the draft code; and the panel must prepare and give the chief executive the draft code by the day stated in the schedule.
(sec.162-ssec.4) However, the technical advisory panel may, after having regard to the matters mentioned in section 163 (1) but within 2 months of being established, recommend to the chief executive that the draft code should not be prepared.

(sec.162-ssec.7) In this section— schedule means the schedule published under section 159B .

- (b) the panel must prepare and give the chief executive the draft code by the day stated in the schedule.
