### sec.123 Local government’s waste reduction and recycling plan obligation
On and from the day prescribed under a regulation, a local government has an obligation at all times to ensure that—
all aspects of waste management in its local government area are comprehensively addressed by 1 or more waste reduction and recycling plans; and
each waste reduction and recycling plan has been prepared by the local government or with its approval, and has been adopted by the local government; and
each waste reduction and recycling plan is being implemented in accordance with its terms.
Without limiting subsection (1) , the local government’s waste reduction and recycling plans must, to the extent reasonably practicable, include the following—
waste reduction and recycling targets for—
waste generated by the local government in carrying out its activities; and
waste generated by households in the local government’s local government area; and
other waste generated in the local government’s local government area other than by the local government;
actions to be taken to improve waste reduction and recycling of—
waste generated by the local government in carrying out its activities; and
waste generated by households in the local government’s local government area; and
other waste generated in the local government’s local government area other than by the local government;
details of current and proposed waste infrastructure;
the management and monitoring of the local government’s performance under the plans;
information about achieving continuous improvement in waste management;
other matters prescribed under a regulation about the requirements for a local government’s waste reduction and recycling plans.

(sec.123-ssec.1) On and from the day prescribed under a regulation, a local government has an obligation at all times to ensure that— all aspects of waste management in its local government area are comprehensively addressed by 1 or more waste reduction and recycling plans; and each waste reduction and recycling plan has been prepared by the local government or with its approval, and has been adopted by the local government; and each waste reduction and recycling plan is being implemented in accordance with its terms.
(sec.123-ssec.2) Without limiting subsection (1) , the local government’s waste reduction and recycling plans must, to the extent reasonably practicable, include the following— waste reduction and recycling targets for— waste generated by the local government in carrying out its activities; and waste generated by households in the local government’s local government area; and other waste generated in the local government’s local government area other than by the local government; actions to be taken to improve waste reduction and recycling of— waste generated by the local government in carrying out its activities; and waste generated by households in the local government’s local government area; and other waste generated in the local government’s local government area other than by the local government; details of current and proposed waste infrastructure; the management and monitoring of the local government’s performance under the plans; information about achieving continuous improvement in waste management; other matters prescribed under a regulation about the requirements for a local government’s waste reduction and recycling plans.
- (a) all aspects of waste management in its local government area are comprehensively addressed by 1 or more waste reduction and recycling plans; and
- (b) each waste reduction and recycling plan has been prepared by the local government or with its approval, and has been adopted by the local government; and
- (c) each waste reduction and recycling plan is being implemented in accordance with its terms.

- (b) actions to be taken to improve waste reduction and recycling of— (i) waste generated by the local government in carrying out its activities; and (ii) waste generated by households in the local government’s local government area; and (iii) other waste generated in the local government’s local government area other than by the local government;
- (i) waste generated by the local government in carrying out its activities; and
- (ii) waste generated by households in the local government’s local government area; and
- (iii) other waste generated in the local government’s local government area other than by the local government;
- (c) details of current and proposed waste infrastructure;
- (d) the management and monitoring of the local government’s performance under the plans;
- (e) information about achieving continuous improvement in waste management;
- (f) other matters prescribed under a regulation about the requirements for a local government’s waste reduction and recycling plans.
- (i) waste generated by the local government in carrying out its activities; and
- (ii) waste generated by households in the local government’s local government area; and
- (iii) other waste generated in the local government’s local government area other than by the local government;
