### sec.102ZM Requirement to implement plans in application
The Organisation must implement its plans for the following matters as stated in its application for appointment as the Organisation—
establishing and administering the scheme generally;
entering into container recovery agreements with manufacturers of beverage products;
establishing a network of container refund points;
entering into container collection agreements with the operators of container refund points;
achieving any outcomes stated in the Minister’s invitation under section 102D ;
setting the amounts payable under the scheme mentioned in section 99J (2) (d) .
The Organisation must establish and operate a container refund point in a community if—
persons in the community do not have reasonable access to a container refund point; and
the Organisation has not identified another person with whom to enter into a container collection agreement to operate a container refund point in the community.
This section applies subject to a condition of the Organisation’s appointment.
Failure to comply with this section is not an offence but may be a ground for suspending or cancelling a company’s appointment as the Organisation. See section 102V .

(sec.102ZM-ssec.1) The Organisation must implement its plans for the following matters as stated in its application for appointment as the Organisation— establishing and administering the scheme generally; entering into container recovery agreements with manufacturers of beverage products; establishing a network of container refund points; entering into container collection agreements with the operators of container refund points; achieving any outcomes stated in the Minister’s invitation under section 102D ; setting the amounts payable under the scheme mentioned in section 99J (2) (d) .
(sec.102ZM-ssec.2) The Organisation must establish and operate a container refund point in a community if— persons in the community do not have reasonable access to a container refund point; and the Organisation has not identified another person with whom to enter into a container collection agreement to operate a container refund point in the community.

- (a) establishing and administering the scheme generally;
- (b) entering into container recovery agreements with manufacturers of beverage products;
- (c) establishing a network of container refund points;
- (d) entering into container collection agreements with the operators of container refund points;
- (e) achieving any outcomes stated in the Minister’s invitation under section 102D ;
- (f) setting the amounts payable under the scheme mentioned in section 99J (2) (d) .
- (a) persons in the community do not have reasonable access to a container refund point; and
- (b) the Organisation has not identified another person with whom to enter into a container collection agreement to operate a container refund point in the community.
