### sec.85 Notice of intention to defend
Despite an originating process being against a partnership, a notice of intention to defend must not be filed in a partnership name.
A partner who is served with an originating process against a partnership may file a notice of intention to defend only in the partner’s own name.
See rule 114 (Service in relation to a partnership).
However, the proceeding continues in the name of the partnership.

(sec.85-ssec.1) Despite an originating process being against a partnership, a notice of intention to defend must not be filed in a partnership name.
