### sec.763 Appeals from refusal of applications made in the absence of parties
If a judge refuses an application made in the absence of a party, the party who made the application may renew the application in the absence of the other party by way of appeal to the Court of Appeal.
The application may be made at any sitting of the Court of Appeal held within 4 business days after the day of the refusal or, for an application refused by a judge sitting in the Central Region, Northern Region or Far Northern Region, 14 days after the day of the refusal, or any further time the Court of Appeal may allow.
