### sec.716 No participation by a party
This rule applies if—
a costs assessor is appointed to carry out a costs assessment; and
a party to the application for the costs assessment does not participate in the costs assessment in accordance with the procedure decided by the costs assessor.
The costs assessor may—
proceed with the assessment without the party’s participation; or
refer the application to the court for directions.

(sec.716-ssec.1) This rule applies if— a costs assessor is appointed to carry out a costs assessment; and a party to the application for the costs assessment does not participate in the costs assessment in accordance with the procedure decided by the costs assessor.
(sec.716-ssec.2) The costs assessor may— proceed with the assessment without the party’s participation; or refer the application to the court for directions.
- (a) a costs assessor is appointed to carry out a costs assessment; and
- (b) a party to the application for the costs assessment does not participate in the costs assessment in accordance with the procedure decided by the costs assessor.
