### sec.509 Assessment
Unless the court directs otherwise, an assessment of damages must be conducted as nearly as possible in the same way as a trial.
The hearing date for assessment must be fixed under part 2 .
When the hearing date is fixed, the plaintiff must serve notice of the hearing date on the defendant.
However, if judgment is obtained in a Magistrates Court under chapter 9 , part 1 , subrule (3) does not apply and the registrar may proceed immediately to assess damages or refer the assessment of damages to a court constituted by a magistrate, without notice to the party against whom the judgment was obtained.
