### sec.181 Conduct of counterclaim
These rules apply to the conduct of a counterclaim with necessary changes as if—
the plaintiff on the counterclaim were the plaintiff in an original proceeding; and
the defendant to the counterclaim were the defendant to an original proceeding.
Chapter 4 does not apply to a defendant to a counterclaim who is a party to the original proceeding.
Subject to rule 182 , a counterclaim must be tried at the trial of the plaintiff’s claim.
(sec.181-ssec.1) These rules apply to the conduct of a counterclaim with necessary changes as if— the plaintiff on the counterclaim were the plaintiff in an original proceeding; and the defendant to the counterclaim were the defendant to an original proceeding.
(sec.181-ssec.2) Chapter 4 does not apply to a defendant to a counterclaim who is a party to the original proceeding.
(sec.181-ssec.3) Subject to rule 182 , a counterclaim must be tried at the trial of the plaintiff’s claim.
- (a) the plaintiff on the counterclaim were the plaintiff in an original proceeding; and
- (b) the defendant to the counterclaim were the defendant to an original proceeding.
