### sec.151 Presumed facts
A party is not required to plead a fact if—
the law presumes the fact in the party’s favour; or
the burden of proving the fact does not lie with the party.
Subrule (1) does not apply if it is necessary to plead the fact—
to comply with rule 149 ; or
to meet a denial pleaded by another party.
(sec.151-ssec.1) A party is not required to plead a fact if— the law presumes the fact in the party’s favour; or the burden of proving the fact does not lie with the party.
(sec.151-ssec.2) Subrule (1) does not apply if it is necessary to plead the fact— to comply with rule 149 ; or to meet a denial pleaded by another party.
