### sec.129B Leave to proceed if no notice filed by person
If a claim is served on a person outside Australia and the person does not file a notice of intention to defend, the party serving the claim may proceed against the person served only with the leave of the court.
An application for leave under subrule (1) may be made without serving notice of the application on the person served with the originating process.
