### sec.31 Application of part
Except where otherwise provided in this part, the provisions of this part shall apply whether or not a contrary intention is expressed in the instrument (if any) creating the trust.
The powers conferred on a trustee by this part are exercisable by the trustee notwithstanding any lapse of time, or that all the beneficiaries are absolutely entitled to the trust property and are not under a disability, except so far as such powers are expressly revoked by all such beneficiaries by notice in writing to the trustee.
A statutory trustee shall not, except with the sanction of the court, exercise any of the powers conferred by section 32 (1) , other than the power conferred by section 32 (1) (d) , or by section 45 .
