94A Applications to Supreme Court
(1) A relevant person may apply to the Supreme Court for relief in
relation to the administration of a trust for charitable purposes if—
(a) there is a breach, or the person suspects there is a breach, of the
trust; or
(b) the person is satisfied that a direction or order of the court is
necessary for the administration or management of the trust or
to the advantage or benefit of the trust.
(2) The application must set out—
(a) the breach or suspected breach and the relief sought; or
(b) the necessary direction or order and why it is necessary.
(3) Each of the following is a relevant person for this section:
(a) the Attorney-General;
(b) a trustee of the trust;
(c) a beneficiary of the trust;
(d) a person named in the instrument establishing the trust as
someone who must, or may, be consulted before the distribution
or use of property (including money) for the purposes of the
(e) a person who received property (including money) from the
trustees for the purposes of the trust;
(f) a person in a class of people the trust is intended to benefit;
(g) a person who satisfies the Supreme Court that the person has a
relevant interest in the trust.
