### sec.65 Limitation on new decisions under s 62 (1)
If there is a permitted road access location for land, the chief executive may make a new decision under section 62 (1) for the land on the chief executive’s own initiative only if the chief executive considers the permitted road access location, road access works associated with it, or the use of either of them—
by themselves, or with other factors—
are creating or may in the future create a traffic hazard; or
are reducing or may in the future reduce safety; or
are having or may in the future have an adverse effect on traffic operations; or
require emergency action; or
has become or may in the future become an obstacle to—
the carrying out of road works on a State-controlled road; or
the construction, augmentation, alteration or maintenance of ancillary works and encroachments, or public utility plant, on a State-controlled road.

- (a) by themselves, or with other factors— (i) are creating or may in the future create a traffic hazard; or (ii) are reducing or may in the future reduce safety; or (iii) are having or may in the future have an adverse effect on traffic operations; or
- (i) are creating or may in the future create a traffic hazard; or
- (ii) are reducing or may in the future reduce safety; or
- (iii) are having or may in the future have an adverse effect on traffic operations; or
- (b) require emergency action; or
- (c) has become or may in the future become an obstacle to— (i) the carrying out of road works on a State-controlled road; or (ii) the construction, augmentation, alteration or maintenance of ancillary works and encroachments, or public utility plant, on a State-controlled road.
- (i) the carrying out of road works on a State-controlled road; or
- (ii) the construction, augmentation, alteration or maintenance of ancillary works and encroachments, or public utility plant, on a State-controlled road.
- (i) are creating or may in the future create a traffic hazard; or
- (ii) are reducing or may in the future reduce safety; or
- (iii) are having or may in the future have an adverse effect on traffic operations; or
- (i) the carrying out of road works on a State-controlled road; or
- (ii) the construction, augmentation, alteration or maintenance of ancillary works and encroachments, or public utility plant, on a State-controlled road.
