### sec.451 Duties when transporting dangerous goods
A person involved in transporting dangerous goods by rail must ensure, as far as is practicable, that the goods are transported safely.
A person involved in transporting dangerous goods by rail must not contravene this chapter or a dangerous goods regulation in circumstances in which the person knew, or ought reasonably to have known, that the contravention would be likely to endanger the safety of another person or of property or the environment.
Maximum penalty—
if the contravention results in death or grievous bodily harm to a person—1,000 penalty units or 2 years imprisonment; or
otherwise—500 penalty units or 1 year’s imprisonment.
This section applies in addition to, and does not limit, any other provision of this chapter or a dangerous goods regulation.
