### sec.444 Grounds for amending, suspending or cancelling approval or exemption
It is a ground for amending, suspending or cancelling an approval or exemption if the approval or exemption was—
granted because of a document or representation that is false or misleading; or
obtained or made in another improper way.
It is a ground for amending, suspending or cancelling an approval or exemption if the person, or 1 or more of the persons, to whom the approval or exemption applies—
has contravened a condition of the approval or exemption; or
has been convicted of a dangerous goods offence or of an offence against a law of another State or the Commonwealth about transporting dangerous goods by rail.
It is also a ground for amending, suspending or cancelling an exemption if—
public safety has been endangered, or is likely to be endangered because of the exemption; or
the chief executive considers that if he or she were dealing with an application for the exemption again (a notional application ), the chief executive would not be satisfied, as mentioned in section 443 (2) , in relation to the granting of the notional application; or
the chief executive considers it necessary in the public interest.
It is also a ground for amending, suspending or cancelling an approval if—
public safety has been endangered, or is likely to be endangered because of the exemption; or
the chief executive considers it necessary in the public interest.

(sec.444-ssec.1) It is a ground for amending, suspending or cancelling an approval or exemption if the approval or exemption was— granted because of a document or representation that is false or misleading; or obtained or made in another improper way.
(sec.444-ssec.2) It is a ground for amending, suspending or cancelling an approval or exemption if the person, or 1 or more of the persons, to whom the approval or exemption applies— has contravened a condition of the approval or exemption; or has been convicted of a dangerous goods offence or of an offence against a law of another State or the Commonwealth about transporting dangerous goods by rail.

- (a) granted because of a document or representation that is false or misleading; or
- (b) obtained or made in another improper way.
- (a) has contravened a condition of the approval or exemption; or
