An owner of land that is entered, occupied or used under section 35 may give a written notice to the chief executive claiming compensation for physical damage caused by the entry, occupation or use or for the taking or consumption of materials.
Compensation is not payable unless a claim is received by the chief executive within 1 year after occupation or use has ended.
However, the chief executive may allow a claim to be made at a later time.
Compensation awarded under this section must not be more than the compensation that would have been awarded if the land had been acquired.
