### sec.349 Authority to enter or temporarily occupy or use land
For the performance of a function under this chapter, the chief executive, or someone authorised in writing by the chief executive, may—
do 1 or more of the following in relation to land—
enter the land, whether or not for temporarily occupying or using the land;
temporarily occupy the land;
temporarily use the land; and
do anything on the land necessary or convenient for the function, including, for example, for light rail transport infrastructure works.
However, the chief executive must not authorise a person to enter land under this section if the entry is a type of entry able to be authorised under an investigator’s authority under chapter 11 .

- (a) do 1 or more of the following in relation to land— (i) enter the land, whether or not for temporarily occupying or using the land; (ii) temporarily occupy the land; (iii) temporarily use the land; and
- (i) enter the land, whether or not for temporarily occupying or using the land;
- (ii) temporarily occupy the land;
- (iii) temporarily use the land; and
- (b) do anything on the land necessary or convenient for the function, including, for example, for light rail transport infrastructure works.
