### sec.320 Public utility provider to consult with chief executive before replacing public utility plant If a public utility provider proposes to replace the whole or a substantial proportion of its public utility plant on busway land, the provider must, before seeking written agreement under section 318 , consult with the chief executive. The object of the consultation is to identify mutually beneficial arrangements for the replacement of the public utility plant, having regard to existing development plans for the busway land. s 320 ins 2000 No. 40 s 13 (sec.320-ssec.1) If a public utility provider proposes to replace the whole or a substantial proportion of its public utility plant on busway land, the provider must, before seeking written agreement under section 318 , consult with the chief executive.
